A quote request is not a confirmed booking. A delivery is accepted only when American Courier Solutions confirms the service details, price, and availability.
1. Acceptance of these terms
These Terms of Service (“Terms”) govern your access to the American Courier Solutions (“ACS,” “we,” “us,” or “our”) website and your request or use of courier, delivery, route coordination, and related services (collectively, the “Services”). By requesting, booking, paying for, or using Services, you agree to these Terms and any written quote, service confirmation, or special instructions that ACS accepts.
If you request Services for a company or another person, you represent that you have authority to bind that person or entity to these Terms. If you do not agree, do not request or use the Services.
2. Quote requests and bookings
Requests are not bookings
Submitting the website form, sending an email, or requesting an estimate does not require ACS to accept a job and does not reserve a courier, vehicle, route, pickup time, or delivery time. A job is booked only after ACS confirms acceptance and the customer approves the applicable price and service details.
Accuracy of information
Quotes rely on the information provided by the customer, including addresses, stops, timing, contact information, item description, dimensions, weight, quantity, value, packaging, access conditions, waiting requirements, and special handling. ACS may revise or cancel a quote if that information is incomplete or inaccurate or if the actual job differs from the request.
Availability
All Services are subject to availability, route conditions, item acceptance, legal restrictions, and final confirmation. ACS may decline any request in its reasonable discretion, including requests that appear unsafe, unlawful, impractical, inadequately described, or outside available capabilities.
3. Customer responsibilities
The customer is responsible for:
- Providing complete and accurate job information and promptly disclosing any change.
- Having legal ownership, custody, or authority to release every item and authorize its transportation and delivery.
- Ensuring that the sender, recipient, and all necessary building or location personnel know about and permit the pickup or delivery.
- Providing accurate contact information and making an authorized person available during the applicable pickup and delivery windows.
- Packaging, sealing, labeling, and preparing items so they can be handled and transported safely under ordinary delivery conditions.
- Disclosing fragile, perishable, temperature-sensitive, high-value, dangerous, regulated, confidential, or unusually shaped items before a quote is accepted.
- Providing safe, lawful, and reasonable access, including information about stairs, elevators, loading areas, parking, security desks, identification rules, permits, and equipment needs.
- Removing or securing personal data, passwords, and confidential information from devices and materials when practicable.
ACS may rely on the description and instructions provided by the customer and is not required to inspect sealed packages or verify ownership, contents, value, or legal status. ACS may refuse an item that appears unsafe, damaged, inadequately packaged, misrepresented, or prohibited.
4. Prohibited and restricted items
Unless expressly approved by ACS in writing and transported in full compliance with applicable law, the following items are prohibited:
- Illegal goods, stolen property, contraband, or items obtained or offered for an unlawful purpose.
- Firearms, ammunition, explosives, fireworks, weapons, or weapon components.
- Hazardous, toxic, radioactive, corrosive, infectious, or flammable substances and materials regulated as dangerous goods.
- Controlled substances, prescription drugs, medical specimens, biological material, medical waste, or patient records requiring regulated handling.
- Cash, bearer instruments, negotiable securities, lottery tickets, precious metals, loose gems, or similar items readily convertible to cash.
- Live animals, human remains, cremated remains, or animal remains.
- Items whose possession, transport, pickup, or delivery would violate a law, regulation, court order, building rule, carrier restriction, or third-party right.
Perishable goods, temperature-sensitive products, alcohol, tobacco, high-value property, fine art, antiques, jewelry, fragile items, and oversized or unusually heavy items require advance disclosure and written acceptance. Acceptance of one job does not mean that a similar item will be accepted in the future.
5. Pickup and delivery performance
Timing
Pickup and delivery times are estimates unless ACS expressly provides a written guarantee. Traffic, weather, road closures, security procedures, building access, recipient availability, incorrect information, vehicle issues, public emergencies, and other circumstances may affect timing. ACS will not be responsible for a delay caused by circumstances beyond its reasonable control.
Waiting and access
The customer is responsible for ensuring timely access at each stop. Additional charges may apply when a courier must wait, make another attempt, use paid parking or toll roads, handle unreported stairs or access conditions, travel to a changed address, or perform work outside the confirmed scope. Any additional charge will be communicated as reasonably practicable.
Handoff
Unless different instructions are accepted in writing, ACS may complete delivery to the named recipient, a receptionist, doorman, mailroom, loading dock, front desk, household or business representative, or another person reasonably appearing authorized at the delivery location. The customer is responsible for requesting any specific identification, signature, or handoff requirement before the job is accepted.
Unsuccessful delivery
If pickup or delivery cannot be completed because of inaccurate information, lack of access, an unavailable contact, refusal, unsafe conditions, or another circumstance outside ACS’s reasonable control, ACS may return, hold, or redirect the item based on customer instructions. Additional service, storage, waiting, return, or disposal charges may apply. ACS will not abandon or dispose of property except as permitted by law and after reasonable efforts to obtain instructions when practicable.
6. Prices, payment, cancellation, and changes
The customer agrees to pay the confirmed service price and any authorized or reasonably necessary additional charges arising from inaccurate job information, route or timing changes, added stops, waiting, parking, tolls, redelivery, returns, special equipment, storage, or work outside the confirmed scope.
Payment timing and accepted payment methods will be stated in the quote or service confirmation. The customer is responsible for applicable taxes, fees, chargebacks, and collection costs to the extent permitted by law.
A cancellation or change is effective only when ACS confirms it. Charges may apply after a courier has been assigned or dispatched, after work has begun, or when ACS has incurred a nonrefundable cost. The applicable amount will depend on the timing and work performed and will be stated in the quote or communicated before the changed work proceeds when reasonably possible.
7. Loss, damage, claims, and liability
Inspection and notice
The recipient should inspect the item promptly at delivery. Any claim for visible loss or damage should be reported as soon as possible and no later than seven calendar days after delivery, with the service confirmation, photographs, proof of value, packaging information, and a description of the claimed loss. Concealed damage should be reported promptly after discovery. A delay in notice may affect our ability to investigate and may limit a claim to the extent permitted by law.
Excluded loss
To the maximum extent permitted by law, ACS is not responsible for loss or damage caused by inadequate packaging; ordinary wear; inherent defect or deterioration; inaccurate or incomplete instructions; undisclosed fragility, value, or handling needs; prohibited items; acts or omissions of the customer, sender, recipient, property personnel, or another third party; or events outside ACS’s reasonable control.
Value and additional coverage
The customer must disclose the actual value of high-value items before booking. Any declared-value limit, additional protection, or insurance must be stated in the written quote or service confirmation. ACS does not provide insurance or accept increased liability merely because an item’s value is stated in an email or form.
Limitation of damages
To the maximum extent permitted by law, ACS will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business, loss of use, missed opportunities, or damages arising from delay. Any specific limit on liability for loss of or damage to an item will be disclosed in the applicable quote or service confirmation. Nothing in these Terms limits liability that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by law, the customer agrees to defend, indemnify, and hold harmless ACS and its personnel and service providers from third-party claims, losses, fines, penalties, and reasonable costs arising from the customer’s breach of these Terms, unlawful or prohibited items, inaccurate information, lack of authority, inadequate packaging, or violation of another person’s rights.
8. Independent service providers
ACS may use employees, independent contractors, motor carriers, couriers, drivers, or other service providers to quote, arrange, or perform Services. No customer may direct a person to violate law, safety requirements, or these Terms.
9. Website use and intellectual property
The website is provided for lawful business and personal service inquiries. You may not interfere with the website, attempt unauthorized access, introduce malicious code, scrape it in a manner that burdens the service, impersonate another person, or use the website to make a fraudulent or unlawful request.
The website design, text, graphics, logos, and other original content are owned by or licensed to ACS and are protected by applicable intellectual-property laws. You may use the website only for its intended purpose and may not reproduce or exploit its content without permission, except as permitted by law.
10. Electronic communications
You consent to receive communications about requests, quotes, bookings, pickups, deliveries, billing, and support by email, telephone, or text at the contact information you provide. Message and data rates may apply. Operational communications are part of the requested service and are not marketing messages.
11. General terms
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be brought in a state or federal court with jurisdiction in New York County, New York, and each party consents to that venue and jurisdiction.
Entire agreement and priority
These Terms, the Privacy Policy, and the applicable written quote or service confirmation form the agreement concerning a Service. If a written quote or service confirmation expressly conflicts with these Terms, the specific written term controls for that Service.
Severability and waiver
If a provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
Changes
ACS may update these Terms by posting a revised version with a new effective date. The version in effect when a Service is confirmed will govern that Service unless the parties agree otherwise in writing.
